RENTAL AGREEMENT -Policies & Rules

This Short-Term Rental Agreement (the “Agreement”) is made by and between the Property Manager of Rivervail Farm Properties (the “Owner”) and the renter and their guests (“Guest”) as of the date last set forth on the signature page of this Agreement. 

Please review the terms and conditions of the ‘RENTAL AGREEMENT -Policies & Rules’. Breaking of any of the property rules and policies will result in immediate eviction and forfeit of entire payment. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree to abide by the policies and rules listed here:

Cancellation Policy: 100% refund for cancellations more than 14 days before check-in date.

50% refund for cancellations more than 5 days before check-in date. We do not offer refunds outside of our cancellation policy, regardless of reason.

Payment: Please call the Property Manager to hold the room with your credit card. We will not charge your card until you check in, or upon cancellation if deposit is forfeited. Final payment is due upon (or prior to) arrival.

Minimum Stay: This property requires a 2-night minimum stay (unless otherwise agreed upon). Longer minimum stays may be required during holiday periods. If a rental is taken for less than 2 days, the guest will be charged the 2-night minimum rate.

Additional fees to be considered if: Damage to the property or furnishings. Dirt or other mess requiring excessive cleaning. Any other cost incurred by Owner due to Guest’s stay.

CHECK-IN / CHECK-OUT: prior to your arrival, Rivervail Farm will notify you of your Check-In instructions. Check-Ins may occur after 3:00 PM and Check –Outs occur at 11:00 AM or before, on your departure date. Early Check-Ins or late Check-Outs must be agreed to by Rivervail Farm and may incur additional fees.

AGE/GUEST OCCUPANCY: Renter responsible for booking the reservation must be 25 years of age or older and be present during the entire reservation. Property is limited to the maximum occupancy stated in your rental agreement. Maximum Occupancy: Hayloft: 6 people, Nook: 4 People, Tea House: 2, Damm House Suites: 4 people each. People other than those in the Guest party set forth above may not stay overnight in the property. All persons on the property are the sole responsibility of the Guest.

SUBLETTING: Property may not be sublet by Renter. Please contact the Property Manager to make changes to the reservation.

ACCESS: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

PROPERTY KEYS: Renter may be charged up to a $75 lock-out fee for lock-out calls after 8:00pm. Lost or unreturned property keys will result in a $100 replacement charge to Renter.

PETS: are not permitted in the Damm House Inn (with the exception of service dogs). Well behaved dogs are allowed to stay at the Nook, Tea House and the Hayloft. We have a strict leash policy, the dog must be on a leash at all times while outside, no exceptions. Please bring doggy bags to pick up after them. Bring your dog’s own bedding and do not allow them on the furniture. Do not tether them outside and leave them unattended. If you must leave your dog behind in the unit while you are out, you must kennel/crate them. Excessive noise may result in eviction, please be considerate of others staying at the farm. You must inform us if you have a dog joining you, there is a $20 pet fee. Please let us know if a service pet will be assisting you during your stay, pet policies are for service as well. The pet fee is not charged for service dogs.

SUPPLIES: Property will have a startup supply of consumables (toilet paper, soap).

HOUSEKEEPING: there is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not allow towels or linens to be taken from the unit. If you need extra bath towels or beach towels, please contact the property manager.

LINENS: Property beds will be made with clean linens prior to the arrival date. Property includes enough towels, wash cloths, pillows and blankets to accommodate each suite/unit. 

QUIET HOURS: For the enjoyment of all guests and neighbors, please be courteous and aware of noise levels at all times. Quiet hours are 10pm – 6pm.

POTENTIAL FOR NOISE: Please note that we rent several other units, please expect some noise during the daytime hours. We are located right on RT 26, and although we are a rural area, there can be traffic noise. Local snowmobile and ATV trails are close to the farm. The Cafe downstairs in the Damm House is open to the public from 7am-2pm. Quite time for our guests is 10pm-6am.

FIREWORKS: Fireworks are prohibited from all Rivervail Farm managed properties and may violate local ordinances.  

POLICE ENFORCEMENT: Any police enforcement actions by the state or county may result in immediate eviction and forfeiture of all amounts paid.

CONSTRUCTION AROUND PROPERTY: Rivervail Farm and Property owner are not responsible for any reimbursements or relocation of Renter due to construction in the vicinity of the Property.  

SEPTIC/WELL: This property is on a well and septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. Feminine products or wipes of any kind (this includes wipes labeled “flushable”) should never be flushed at any time. If it is found that anything other than toilet paper has been flushed and clogs the septic system, you could be charged damages of up to $1,000.00.

SMOKING: All Rivervail Farm managed properties are smoke free. Evidence of smoking inside the buildings will result in immediate eviction and forfeiture of all amounts paid. Additional cleaning fees may result. Smoking is allowed outside only, and must be 25 feet away from any public entrance. Do not discard cigarette butts on the ground.

PARKING / DRIVEWAYS: Parking is provided in the designated areas for each unit. The parking lot is shared by many, please do not block driveways.

CLEANING/PROPERTY CARE: Renter is required to leave Property in the same general condition as found upon arrival. Excess cleaning fees may be charged to Renter accordingly upon departure. Keep the property and all furnishings in good order. Only use appliances for their intended uses. Each unit has its own check-out list, please inquire.

DAMAGES: Upon arrival, if you notice any damage to the property, please immediately notify Rivervail Farm. Any damage outside normal wear and tear to the property is the responsibility of the Renter.  

CAUSE FOR EVICTION: Renter and guests of Renter will be subject to immediate eviction from the property if they violate any terms of this agreement, including but not limited to; violation of occupancy limits, pet policies, smoking, noise disturbances or fireworks. In the event of eviction from the property, Renter must vacate the property immediately and forfeit any and all amounts paid.  

PROPERTY CONCERNS / QUESTIONS: If at any time during your stay you have questions or concerns, please contact the Property Manager at Rivervail Farm Properties, we’re happy to answer any questions or address any concerns you may have.  

LIABILITY AND HOLD HARMLESS Renter and guests of Renter agree to defend, indemnify and hold harmless Rivervail Farm and represented Property owner from and against all claims, demands, loss, liability of any kind and character, including cost of defense, arising out of or in any ways connected with Renters use of the property in the event Renter or guest of Renter suffer personal, physical, property damage, injury, or loss. Rivervail Farm and property managers and owners are not responsible for lost or stolen items in or around the Property. This unit is privately owned. The owners are not responsible for any accidents, injuries or illness that occurs while on these premises. The Owners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of harm arising from their use of the premises or others whom they invite to use the premises.
